Terms and Conditions

Notice: This text is a general template prepared for the Betonna platform. The platform owner should review it with a qualified legal adviser before launch and adapt it to the business and to the laws in force in Iraq.

1. Introduction

Welcome to Betonna. These Terms and Conditions govern your use of our website, our mobile apps and all related services (together, the "Platform"). By using the Platform or creating an account, you agree to these terms. If you do not agree, please do not use the Platform.

2. Definitions

• Platform: the Betonna website, apps and services.
• User: anyone who browses the Platform or holds an account on it.
• Client: a user who looks for a property or a service, or lists their own property in a personal capacity.
• Real-estate company: a business engaged in real-estate activity that is registered and approved on the Platform to publish listings.
• Representative: a person added by a real-estate company to its team to act on its behalf on the Platform.
• Service provider: an individual or business approved in the services directory offering services such as maintenance, cleaning, moving, legal advice or interior design.
• Listing: any property or content published on the Platform for display to users.
• Plan: a paid subscription that gives a real-estate company or a service provider specific features for a set period.

3. Eligibility and accounts

• You must be at least 18 years old and legally able to enter into contracts.
• You must provide true and complete information and keep it up to date, including a phone number that can be verified.
• You are responsible for keeping your sign-in details confidential and for all activity under your account. Tell us immediately if you suspect any unauthorised use.
• We may refuse any registration or approval request without giving reasons, to the extent permitted by law.

4. Obligations of real-estate companies and service providers

• Obtain and maintain the licences and permits required for your activity, and provide proof of them on request.
• Publish true and accurate listings that reflect the real property in description, photos, price, location and legal status.
• Do not publish fake or duplicate listings or properties that are not available, and update or remove a listing as soon as the property is sold or rented.
• Hold the necessary authorisation from the property owner before listing a property.
• Respond to client inquiries and requests honestly and respectfully, without misleading promises or offers.
• A real-estate company is responsible for the activity of its representatives on the Platform and must remove access for any representative who leaves its team.
• A service provider must work within the categories and cities it has chosen, send clear quotes and honour what it agrees with the client.

5. Obligations of clients

• Use the Platform for lawful and genuine purposes, and give accurate information when contacting others or requesting services.
• When listing your own property, follow the listing rules and be the owner of the property or authorised to list it.
• Write honest ratings based on a real experience.
• Check the property, its documents and the identity of the other party yourself before paying anything, and never pay a deposit before viewing the property and its documents.

6. Content and intellectual property

The Platform, its design, logos and software belong to Betonna or its licensors. Users keep ownership of the content they publish and grant us a non-exclusive, royalty-free licence to display, copy, resize, format and publish it on the Platform and in promoting the Platform for as long as it is published. Users confirm that they have the right to publish the photos and text they upload and that doing so does not infringe the rights of others.

7. Prohibited use

• Publishing false, misleading, offensive or unlawful content, or content contrary to public morals.
• Impersonating any person or organisation, or creating fake accounts.
• Collecting user data or copying Platform content by automated means without written permission.
• Sending unsolicited advertising or attempting to defraud users.
• Attempting to hack, disrupt or bypass the security of the Platform.
• Manipulating ratings or posting ratings in exchange for a benefit.

8. Moderation and removal

We may review listings, accounts and ratings before or after publication, and recategorise, hide or remove them if they break these terms, the listing rules or the law. Any user can report a listing or an account, and we will review reports and take the action we consider appropriate.

9. Subscriptions, payments and invoices

• Plan prices and features are shown on the pricing page. We may change them with prior notice; changes do not apply to a period already paid for.
• Subscriptions are paid in advance through approved payment gateways, by bank transfer or in cash, and an invoice is issued for every successful payment.
• Subscriptions may renew automatically or manually. If a payment fails, the subscription becomes past due, a grace period follows, and listings are then hidden, not deleted, until payment is made.
• Plan changes take effect at the start of the next billing period. You may cancel at any time and your plan stays active until the end of the paid period.
• Amounts for unused periods are not refunded unless applicable law requires it.

10. Limitation of liability

Betonna is an intermediary platform that allows properties and services to be displayed and users to contact each other. We are not a party to any agreement, sale, rental or service contract concluded between users. We do not guarantee that any transaction will be completed, that everything users publish is accurate despite our review efforts, or the quality of services provided by service providers.

The Platform is provided "as is" and "as available". To the extent permitted by law, we are not liable for any indirect or consequential loss, or loss of profits or data, arising from use of or inability to use the Platform or from dealings with other users.

11. Ratings

Clients may rate real-estate companies and representatives after contacting them, and service providers after a service request. Ratings must be honest and relate to the actual experience. They are moderated, and we may hide any rating that is abusive, misleading or irrelevant. Ratings linked to a completed service request carry a "verified" badge.

12. Suspension and termination

We may suspend, terminate or restrict any account that breaks these terms or the law, or where there are signs of fraud or harm to users. You may close your account at any time from your account settings or by contacting us. Closing an account does not cancel any amounts due before closure.

13. Changes to these terms

We may update these terms from time to time. We will publish the updated version on this page with its effective date and inform you of material changes through the Platform or by e-mail. Continuing to use the Platform after a change takes effect means you accept it.

14. Governing law and jurisdiction

These terms are governed by and interpreted in accordance with the laws of the Republic of Iraq. The courts of Baghdad have jurisdiction over any dispute arising from them, after an attempt to resolve it amicably.
